Book Description
Excerpt from Powers of the American People, Congress, President and Courts, According to Evolution of Constitutional Construction No argument would seem to be necessary to prove the importance of instructing the students of government in the theory and practical character of the powers of the People, Congress, the President, and the Courts of the Uni-ted States. The impression has largely obtained among students of government and others in the Old World that because of its newness the American system could present little of interest or value to 'the investigator; it Has been believed also by many that the American system was inimical to Old World systems. The fact that hitherto no convenient manual of instruction was to be had may have been largely responsible for such misconceptions, and if this work shall be the means of removing such impressions it will have accomplished its purpose. Book Description
Excerpt from Powers of the American People: Congress, President, and Courts, (According to the Evolution of Constitutional Construction) But whoever the investigator may be, he should not fail to observe the fact that the ceaseless progression of mankind has ever been welding the human family into a unit. In that prog ress, all governments - be they aristocratic, monarchical, or re publican - are undergoing a process of evolution. Whether or not the progression seems to result in undue advantages by one nation as against another, it tends to the ultimate good of the human family. Whether the nations like it or dislike it, Whether they approve it or disapprove it, they are steadily approaching international amalgamation through a higher humanity and a newer civilization. The American people are inseparable and integral parts of this larger movement toward a common human destiny. Nor is there anything utopian, puerile, or idealistic in the theory of such a movement. Book Description
It's often said, confirmed by survey data, that the American people are losing confidence in their government. But the problem may be the reverse--the government has lost confidence in the people. Increasingly the power to make decisions in our democracy has been shifted from Congress to the court system, forcing non-elected officials to make decisions which affect the lives of Americans. In a society which is based on the democratic elections of its officials, this is clearly backwards. Quirk maintains that what he calls "The Happy Convention," an informal and unwritten rearrangement of "passing the buck" of government powers, is done to avoid blame and approval ratings becoming lower for a particular person or party. For example, The Happy Convention assigns the power to declare and make war to the President. Congress and the Court play a supporting role--Congress, when requested, gives the President a blank check to use force--the Court throws out any challenges to the legality of the war. Everyone wins if the war avoids disaster. If it turns out badly, the President is held accountable. His ratings fall, reelection is out of the question, congressmen say he lied to them; his Party is likely to lose the next election. In this way, Quirk reminds us that The Happy Convention is not what the Founders intended for us. For democracy to work properly, the American people have to know what options they have. Courts and Congress argues the case for reestablishing the balance of powers between the courts, the Congress, and the Presidency.
