Book Description
Excerpt from A Treatise on Deeds As appears from the title page, the present work is founded upon the book published in 1885 by Sir Howard Elphinstone, Mr. Clark, and myself. When a new edition of that work was needed Mr. Clark had been appointed to his present position of Legal Adviser to the Board of Agriculture and Fisheries, and Sir Howard Elphinstone, who was fully engaged in bringing out some of his many works on Conveyancing, asked me to prepare the new edition. As soon as I took the old book in hand I found that it required more than merely re-editing, and I set about reconstructing the entire work. The greater part of the book has been entirely rewritten, all the authorities have been rearranged, and a large amount of additional matter has been incorporated; in fact, so extensive has been the reconstruction that Sir Howard Elphinstone very generously suggested (and Mr. Clark as generously con curred in the suggestion) that the revised book should appear under my name alone. Book Description
Excerpt from Treatise on Deeds and Forms: Used in the Constitution, Transmission, and Extinction of Feudal Rights The plan of the following Treatise embracing a short account of the origin of the different subjects to which it relates, a historical introduction is thus rendered unnecessary. Mr Ross, in his published lectures, led the way in a branch of legal practice, which had formerly been esteemed wholly mechanical, to a more intellectual view of the subject. By means of his inquiries a large store of information on the origin and history of our system of deeds, highly valuable to the lawyer, the student and the practical conveyancer, was collected and bequeathed to the profession. Although the shape of his work is now felt to be inconvenient in reference, its authority remains unimpaired. The Treatise of Mr Robert Bell, on the conveyance of land to a purchaser, is of a more practical nature, and has long been the most useful Manual in the library of the conveyancer. Aware of the large amount both of knowledge of principles and of practical experience which these learned persons brought to bear on their subject, I cannot but feel much diffidence, in offering to the profession a work on the same branch of practice. Book Description
Excerpt from Treatise on Deeds: Chiefly Affecting Moveables IN the following Work I have employed the arrangement adopted in my Treatise on another branch of the subject, Feudal Conveyancing. The division is into Chapters, Titles and Sections these last being occasionally subdivided into Articles. The numbers of the sections are carried on to the conclusion; and it is necessary to observe, that re ferences to other parts of the work are by the section, or the section and article, not by the page. The number of the section with which a page concludes is repeated at the top of the following page, below the figures denoting the page. The figures in the Index refer to the page. Book Description
Excerpt from A Treatise on the Law of Real Property The author gladly gives credit to the legal writers and authorities on whom he has always based his work as a student and teacher as well as a writer. For that part of the work devoted to the history of the law of real property and the common law of England, special credit is due to Digby's History of the Law of Real Property, and Williams Real Property. Most of the lists of cases used as the basis of the work were drawn from the American and English Cyclopaedia of Law, Cyc., Washburn on Real Property, and the admirable and more extensive works on real property by Professor Tiffany and Professor Reeves. These cases were examined and the notes taken therefrom became the basis of the text. Professor Gray's cases on property have been the basis of the author's work as student and teacher, arid have been drawn from freely in this work. His work on Perpetuities, together with his cases on that topic, con vtitute the basis of the chapter on Perpetuities. Special credit is also due Professor Tiffany's comprehensive and scholarly work on Landlord and Tenant. Wm. F. Walsh. New York University Law School. November, 1915. Book Description
Excerpt from Title-Deeds of the Church of England: To Her Parochial Endowments The principal aim of the writer in collecting and putting together the information contained in the following pages has been to clear away certain factious and mischievous obstructions to the free course of dispassionate discussion of one of the gravest questions of the present day - the religious propriety and political expediency of maintaining a national Church Establishment. It has been found almost impossible to argue the negative view of that question, but especially to base upon that view any direct political action, without being indignantly assailed as making an attempt to subvert the rights of property. Cries of "spoliation," "robbery," "sacrilege," and the like, have been instantly raised to cut short the argument, or to bury political effort beneath an overwhelming weight of scornful vituperation.
