This book focuses specifically on the experience and protection of indigenous, and particularly Sámi sacred sites in the Arctic. Sacred sites are being increasingly recognized as important reservoirs of Arctic cultural and biological diversity, as a means for the transmission of culture and identity, and a tool for the preservation of fragile northern social-ecological systems. Yet, legal protection of Arctic sacred sites and related policies are often still lacking or absent. It becomes increasingly difficult for site custodians in the Arctic to protect these ancient sites, due to disruptive changes, such as climate change, economic developments and infrastructural development. With contributions from Sámi and non-Sámi scholars from Arctic regions, this book provides new insights into our understanding of the significance and legal protection of sacred sites for Sámi of the Arctic. Indigenous Peoples and Human Rights explores how general human rights standards have enabled, empowered and constrained indigenous peoples in claiming and defending their essential economic, social, cultural, civil and political interests. The book examines the jurisprudence of United Nations treaty committees and regional human rights bodies (in Africa, the Americas and Europe) that have interpreted and applied human rights standards to the special circumstances and experiences of indigenous peoples. It focuses particularly on how human rights laws since the 1960s have been drawn upon by indigenous activists and victims to protect their interests in ancestral lands, natural resources, culture and language. It further explores the right to indigenous self-determination; civil and political rights; economic, social and cultural rights (including labour rights); family and children's rights; violence and discrimination against indigenous peoples; and access to justice and remedies for violations. In many areas of the world, there has been an earlier indigenous population, which has been conquered by a more recent population group. In Social Welfare with Indigenous Peoples, the editors and contributors examine the treatment of many indigenous populations from five continental areas: Africa (Sierra Leone, Zimbabwe); Australasia, New Zealand; Central and South America (Brazil, Mexico); Europe (Scandinavia, Spain) and North America.
