Book Description
Excerpt from The Central Law Journal, 1874, Vol. 1 We think that Judge Paschal has, in these books, done a work of which he may be justly proud. We think it no exaggeration to say that his first volume stands unrivalled among the American codes. It possesses more elements of usefulness than any book of the kind we have ever had occa sion to use. Nothing is more perplexing to the practitioner, than a body of statute law built upon the basis of a highly refined and cultivated analysis, like that of Blackstone's Commentaries. Add to this the entire absence of cross-references, and the poor indexes which characterize many of the codes, and the difficulties of using them become almost insurmountable. Judge Paschal has wisely arranged his titles alphabetically, and has kept up a thorough system of polyglot references between kindred subjects, so as almost to dispense with the necessity of an index. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Find more at www.forgottenbooks.com This book is a reproduction of an important historical work. Book Description
Excerpt from Mississippi Law Journal, 1928, Vol. 1 The fundamental purpose of the journal is to perform a distinct and valuable service, (a) to the bar of the state by creating a forum Where interesting and Vital legal ques tions of a helpful nature to the profession and the judiciary of the state may be discussed. A forum in which matters peculiarly of interest to the lawyers and law students may find expression. It is true the bar of the state and the law students have had the benefits of great law journals, such as the American Bar J ournal and others of like nature, but these publications do not and can not take care of the local needs. One feature of the journal which should appeal to the bar will be the publication of the annotations of our decisions and statutes to the re-statement of the common law by the American Law Institute. A committee was ap pointed by the Bar Association at the Gulfport meeting charged with the duty of working out some plan where by our decisions and statutes might be annotated to thelaw as restated by the American Law Institute. The com mittee has been able to procure Chief J ustice Sidney Smith and Honorable George Butler of the J ackson Bar, together with members of the law faculty, to annotate our decisions and statutes to the subjects of the law already restated and those subjects partially restated by the American Law In stitute, namely, Conflict of Laws, Torts, Contracts, and Criminal Law. This feature of the journal alone should be of great value to the bar in Mississippi, especially, since the Mississippi Supreme Court will cite the re-statement of the law, (b) it will open a forum for the student of law who is not in the active practice, both in and out of the law school, for the discussion of timely and pertinent legal questions, together with comments on and criticisms of cases and questions of law passed upon by the Mississippi courts. These thought provoking legal discussions will be help ful to every progressive member of the bar. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Description
Excerpt from The Quarterly Law Journal, 1859, Vol. 4 To ascertain the rule for determining the present value of a contingent right of dower, suppose the case of a husband 94 years of age, and a wife 93; and that the annuity of one dollar per annum is payable to A while both are living, to B when both are dead, to C whilethe wife survives the husband, and to D while the husband survives the wife. According to the table of mortality both will be dead after the expiration of six years, B receiving certainly the whole annuity after that time; A, C, and D having no possible chance of receiving any portion after that time. Hence the annuity for the six years alone is subject to division, and the question is what portion of the present value of the annuity for six years shall each of the parties A, B, C and D receive. Book Description
Excerpt from Mississippi Law Journal, Vol. 11: December, 1938 Observe that the essence of value, particularly where 'property' is eu trusted by the 'owner' to another, consists in the expectations of the 'owner'. Loss, conversion to converter's own use, and fraudulent intent also find their meaning in the defeat of these expectations. Conversion to any use other than to the use of the principal is nothing but the defeat of his expectations. The important aspect of fraudulent intent is not any dispute over its sub jective or objective character, nor over whether or not subjective intent can be known, but is its consequences which defeat the expectations of the principal.
