The EU has limited legislative competence in the field of social law. However, the Member States are increasingly modernizing social services and social (welfare) protection, attempting to make social services more efficient by increasingly looking to the market for the provision of such services. This policy move brings social services into the radar of EU law. The EU response to this sensitive issue has resulted in a piecemeal and fragmented approach towards the treatment of a new policy area of Social Services of General Interest (SSGI) in EU law and policy. This book is a first contribution towards charting how SSGI have emerged as a special category of SGI in the EU, the reaction of the Member States and stake-holders and how policy is being made through new governance processes, carve-outs and safe havens in legislation and soft law, especially in the light of the new values of the EU introduced by the Treaty of Lisbon 2009. It takes an inter-disciplinary approach and will be of interest to lawyers, economists and political scientists who are interested in EU policy-making as well as practioners, EU and national policy-makers. This book revives the discussion on public social services and their redesign, with a focus on services relating to care and the social inclusion of vulnerable groups, providing rich information on the changes that occurred in the organisation and supply of public social services over the last thirty years in different European places and service fields. Despite the persisting variety in social service models, three shared trends emerge: public sector disengagement, ‘vertical re-scaling’ of authority and ‘horizontal re-mix’ in the supply system. The consequences of such changes are evaluated from different perspectives – governance, social and territorial cohesion, labour market, gender – and are eventually deemed ‘disruptive’ in both economic and social terms. This book presents comparative analyses and accounts of the institutional changes that have occurred to the local level delivery of public utilities and personal social services in countries across Europe. Guided by a common conceptual frame and written by leading country experts, the book pursues a “developmental” approach to consider how the public/municipal sector-centred institutionalization of service delivery (climaxing in the 1970s) developed through its New Public Management-inspired and European Union market liberalization-driven restructuring of the 1980s and early 1990s. The book also discusses the most recent phase since the late 1990s, which has been marked by further marketization and privatization of service delivery on the one hand, and some return to public sector provision (“remunicipalization”) on the other. Since the 1980s, neoliberals have openly contested the idea that the state should protect the socio-economic well-being of its citizens, making ‘privatization’ their mantra. Yet, as historians and social scientists have shown, welfare has always been a ‘mixed economy’, wherein private and public actors dynamically interacted, collaborating or competing with each other in the provision of welfare services. This book will be of interest to students, scholars and practitioners of welfare by developing three innovative approaches. Firstly, it illuminates the productive nature of public/private entanglements. Far from amounting to a zero-sum game, the interactions between the two sectors have changed over time what welfare encompasses, its contents and targets, often engendering the creation of new fields of intervention. Secondly, this book departs from a well-established tradition of comparison between Western nation-states by using and mixing various scales of analysis (local, national, international and global) and by covering case studies from Spain to Poland and France to Greece in the nineteenth and twentieth centuries. Thirdly, this book goes beyond state centrism in welfare studies by bringing back a host of public and private actors, from municipalities to international organizations, from older charities to modern NGOs. This book explains the increasing demand for evaluation as a result of the increasing frequency of reforms to local services, influenced by the New Public Management doctrine, the severe austerity policy in many European countries, and the wish to increase quality and reduce costs of public services, especially at the local (sub-national) level. This monograph, which was also designed as a short reference book for specialized undergraduate and graduate courses on EU law, intends to shed light on, and legally frame, the evolution of the doctrine of services of general economic interest (SGEIs). The book emphasizes the pivotal role played by SGEIs in striking a fair balance between market and social objectives. To this end, the book claims, first of all, that SGEIs have a dual nature inasmuch as they act as a limitation to/derogation from the free market and, simultaneously, as a value and positive obligation addressed at national authorities, undertakings, and EU institutions. The EU notions of access to public services and universal service are the clearest signal of such phenomenon. Secondly, the book claims that the transfer of competences from the Union to the Member States and the reaffirmation of Member States’ sovereignty in crucial sectors of the economy are not the only solutions to foster social rights. In fact, this narrative is apt to undermine the foundations, spirit, and purpose of the process of European integration, especially at a time like the present, when new forms of populism and anti-Europeanism are on the rise, and when a European response is imperative to counter the spread of the coronavirus in European countries. The book concludes that SGEIs’ regulation is an area of law where the EU institutions have generally successfully put into action and consolidated the social market economy principles on which the EU was founded. This is even further proof that the EU is not merely the reflection of interests linked to market completion, but also and foremost a ‘Community based on the rule of law’. The book will be a valuable resource for academics and researchers in EU Law, European Public Law and EU competition law.

OF 'SOLIDARITY' IN UK SOCIAL WELFARE Here then, perhaps, is a British version of solidarity in social welfare, but early there are strong tensions between the powerfully liberal individualistic strands of the British understanding of the functions of the state and the socialistic or communitarian tendency of a commitment to universal welfare provision. In the search for the roots of this understanding of welfare we shall survey, fitst, the historical background to these tensions in some early British political philosophers, starting with Hobbes and ending with Mill. We then consider the philosophical and social influences on the Beveridge Report itself, and we will trace the emergence of the philosophy of the welfare state in the era following the Second World War. Finally we consider the contemporary debate, as it relates to the 'Third Way' thinking of New Labour. 2. A mSTORICAL SKETCH In the previous section we observed that the philosophy underlying the Beveridge Report could be described as 'liberal collectivism'. What are the historical antecedents of this strange amalgam of individualism and collectivism? Within the short scope of this chapter, any account of the philosophical history must be little more than a sketch, but we can perhaps understand most debates in British socio-political thought as a continuing dialogue with the well known claim of Thomas Hobbes in Leviathan that all political institutions are founded on egoistic motives.

What are public health services? Countries across Europe understand what they are or what they should include differently. This study describes the experiences of nine countries detailing the ways they have opted to organize and finance public health services and train and employ their public health workforce. It covers England France Germany Italy the Netherlands Slovenia Sweden Poland and the Republic of Moldova and aims to give insights into current practice that will support decision-makers in their efforts to strengthen public health capacities and services. Each country chapter captures the historical background of public health services and the context in which they operate; sets out the main organizational structures; assesses the sources of public health financing and how it is allocated; explains the training and employment of the public health workforce; and analyses existing frameworks for quality and performance assessment. The study reveals a wide range of experience and variation across Europe and clearly illustrates two fundamentally different approaches to public health services: integration with curative health services (as in Slovenia or Sweden) or organization and provision through a separate parallel structure (Republic of Moldova). The case studies explore the context that explain this divergence and its implications. This study is the result of close collaboration between the European Observatory on Health Systems and Policies and the WHO Regional Office for Europe Division of Health Systems and Public Health.
