On December 20, 1999, the city of Macau became a Special Administrative Region of China after nearly four hundred and fifty years of Portuguese administration. Drawing extensively on Portuguese and other sources and on interviews with key participants, this book examines the strategies and policies adopted by the Portuguese government during the negotiations. The study sets these events within the larger context of Portugal's retreat from empire, the British experience with Hong Kong, and changing social and political conditions within Macau. A weak player on the international stage, Portugal was still able to obtain concessions during the negotiations, notably in the timing of the retrocession and continuing Portuguese nationality arrangements for some Macau citizens. Yet the tendency of Portuguese leaders to use the Macau question as a tool in their domestic political agendas hampered their ability to develop an effective strategy and left China with the freedom to control the process of negotiation.

With international attention focused on Hong Kong, many forget that Macau also exists in a delicate `one country, two systems’ (OCTS) balance with mainland China. This book provides insights into the circumstances surrounding the less-understood half of China’s OCTS policy, including the stagnation of representational government, and the location of any Macau characteristics in the Macau Basic Law. Despite being Hong Kong’s sister `Special Administrative Region’ (SAR) within the People’s Republic of China, Macau’s unique constitutional development under Portuguese and Chinese administration remains under-appreciated despite its potential contributions to local, national, and international constitutional discourse. Utilizing a multi-disciplinary approach including doctrinal, historical, and comparative methodologies, this work fills that gap. The research blends Portuguese, Chinese, and foreign-language sources in order to reconstruct a balanced constitutional narrative. The book focuses on a consequential effect of globalization – that is, the assimilation of a longstanding and unique constitutional order by a new hegemonic sovereign – including processes for internationalization as China opened up, legal harmonization of two distinct legal and socioeconomic orders, juridification of local affairs with the establishment of a new local court system in preparation for handover to the Chinese regime, and democratization (or the lack thereof) among the various communities comprising the Macanese polity before and since. This is the first book that focuses on the entrenched, fundamental divergence between the Hong Kong Court of Final Appeal and Macau's Tribunal de Última Instância over their constitutional jurisprudence, with the former repeatedly invalidating unconstitutional legislation with finality and the latter having never challenged the constitutionality of legislation at all. This divergence is all the more remarkable when considered in the light of the fact that the two Regions, commonly subject to oversight by China's authoritarian Party-state, possess constitutional frameworks that are nearly identical; feature similar hybrid regimes; and share a lot in history, ethnicity, culture, and language. Informed by political science and economics, this book breaks new ground by locating the cause of this anomaly, studied within the universe of authoritarian constitutionalism, not in the common law-civil law differences between these two former European dependencies, but the disparate levels of political transaction costs therein.
