Today, a substantial portion of higher education is provided outside of the traditional universities in non-university institutions with a multitude of varied characteristics. In recent decades, higher education systems have been subjected to many changes and reforms throughout the world. One of the most important was undoubtedly the expansion of higher education in the second half of the last century from an elite system to one for the masses. While institutions of higher learning have been in existence for approximately 1,000 years, this exponential growth has been much more recent. This movement toward mass higher education has created substantial national impacts on the development of the systems of higher education. While common denominators of change and adaptation can be identified globally, there remain important differences from country to country. There are many factors challenging higher education today and in the foreseeable future. In one form or another, these issues and trends can be seen in higher education systems throughout the world. They include chronic underfunding, marketisation and competition, alternative providers, massification, internationalisation, governance, leadership, strategic management, accountability, accreditation, and social relevance. Another key factor for many countries, especially in Europe, and the focus of this book, is the current and future status of the higher education systems that differentiate the university and non-university sectors.

There is an urgent need to address the social dimension of higher education more forcefully and coherently, particularly in view of the economic downturn across Europe. This is the conclusion of the new Eurydice report, which looks at national policies on access to higher education, funding and student support. The report, covering eu Member States, plus Iceland, Liechtenstein, Norway and Turkey, suggests that countries are struggling to adapt their higher education systems to meet the challenges brought about by rapid societal change in recent years. In particular, they need to open up opportunities for more people to benefit from higher education, matching this objective with coherent measures, funding and monitoring to evaluate their impact. European leaders have agreed a headline target that 40% of 30-34 year olds should have a higher education qualification by 2020--an increase from just over 33% today. The study focuses on three key topics: policies to widen participation in higher education; funding trends; and the impact of student fee and support systems. It reveals that approaches to meet shared European objectives vary greatly between countries and have different impacts on the performance of higher education. For example, there seems to be an East-West divide regarding routes to higher education for non-traditional candidates such as adult learners and people entering university on the basis of skills gained in the workplace rather than school qualifications. The report highlights changes in higher education spending in response to the crisis. Over the past academic year (2010/11 compared to 2009/10) budgets were most increased in Lithuania, Liechtenstein, Austria, France, Finland and Malta, while the deepest cuts were made in Greece, Ireland, Iceland, (8-10% decrease), as well as in Spain, Italy, the Czech Republic and Slovakia (up to 3% decrease). Even if in most countries non-university higher education institutions did not have originally a research mandate, it is well known that in most cases these institutions have progressively developed research activities and, at least in some countries, the State now has recognized the research role of these institutions and provided support and funding. Moreover, in many countries the role of research in polytechnics, ‘fachhochschulen’, ‘hogescholen’, university colleges, etc is on the political agenda. Despite the importance of the issue, there are very few in-depth studies of research in the non-university sector. These studies show that the development of research in these institutions leads to quite complex interactions with universities, both in the sense of convergence (academic drift) and/or of differentiation of a specific research mandate oriented towards the regional economy. Higher education legislation is frequently changed by policy makers, who are acutely conscious that specific changes have repercussions through the law of general applicability, and eventually may alter and revise fundamental societal concepts. However, normative systems are complex, and the impact and direction of legal and social repercussions are neither always intended, nor are they easily foreseen. It is the purpose of this book to identify the chosen directions, and to contribute to the further development of issues in the higher education and research sector and to trace beginnings of new trends. This volume is intended to appeal to the reader's personal, practical perspective to help generate the creativity and inspiration needed in order to maintain the equilibrium between consolidation and change. In the Council of Europe, much thought has been given to these problems in recent years. The Higher Education and Research Committee (CC-HER), previously known as the Standing Conference of University Problems (CC-PU), has established a Legislation Reform Programme for Higher Education (LRP). The Programme is intended to give effective support to the process of legislative reform in higher education, particularly, but not exclusively, in the new member states in central and eastern Europe. To promote dissemination of experience acquired throughout Europe and as a complement to its ongoing advisory and multilateral activities, the Programme's Steering Group has decided to publish a series entitled `Legislating for Higher Education and Research in Europe'. The first volume of this series, Relations between State and Higher Education, is hereby presented to the general public. Relations between State and Higher Education has been compiled in close co-operation with States Parties to the European Cultural Convention. It seeks, as will subsequent volumes, to identify core issues which countries may need to confront in their legislations, and offers examples of good practice.
