Although there is plentiful research on the impact of marriage, employment and the military on desistance from criminal behaviour in the lives of men, far less is known about the factors most important to women’s desistance. Imprisoned women are far more likely than their male counterparts to be the primary caretakers of children before their incarceration, and are far more likely to intend to reunify with their children upon their release from incarceration. This book focuses on the role of mothering in women’s desistance from criminal behaviour. Drawing on original research, this book explores the nature of mothering during incarceration, how mothers maintain a relationship with their children from behind bars and the ways in which mothering makes desistance more or less likely after incarceration. It outlines the ways in which race, gender, class, nationality, sexuality, gender identity, and other characteristics affect mothering and desistance, and explores the tensions between individual and system-level factors in the consideration of desistance. This book suggests that any discussion of desistance, particularly for women, must move beyond the traditional focus on individual characteristics and decision-making. Such a focus overlooks the role played by context and systems which undermine both women's attempts to be mothers and their attempts to desist. By contrast, in the tradition of Beth Richie’s Compelled to Crime, this book explores both the trees and the forests, and the quantum in-between, in a way that aims for lasting societal and individual changes.

When a woman leaves prison, she enters a world of competing messages and conflicting advice. Staff from prison, friends, family members, workers at halfway houses and treatment programs all have something to say about who she is, who she should be, and what she should do. The Ex-Prisoner’s Dilemma offers an in-depth, firsthand look at how the former prisoner manages messages about returning to the community. Over the course of a year, Andrea Leverentz conducted repeated interviews with forty-nine women as they adjusted to life outside of prison and worked to construct new ideas of themselves as former prisoners and as mothers, daughters, sisters, romantic partners, friends, students, and workers. Listening to these women, along with their family members, friends, and co-workers, Leverentz pieces together the narratives they have created to explain their past records and guide their future behavior. She traces where these narratives came from and how they were shaped by factors such as gender, race, maternal status, age, and experiences in prison, halfway houses, and twelve-step programs—factors that in turn shaped the women’s expectations for themselves, and others’ expectations of them. Every day, about 1,600 people are released from prisons in the United States. Of these 600,000 new releasees every year, about 480,000 are subject to parole or some other kind of postrelease supervision. Prison releasees represent a challenge, both to themselves and to the communities to which they return. Will the releasees see parole as an opportunity to be reintegrated into society, with jobs and homes and supportive families and friends? Or will they commit new crimes or violate the terms of their parole contracts? If so, will they be returned to prison or placed under more stringent community supervision? Will the communities to which they return see them as people to be reintegrated or people to be avoided? And, the institution of parole itself is challenged with three different functions: to facilitate reintegration for parolees who are ready for rehabilitation; to deter crime; and to apprehend those parolees who commit new crimes and return them to prison. In recent decades, policy makers, researchers, and program administrators have focused almost exclusively on "recidivism," which is essentially the failure of releasees to refrain from crime or stay out of prison. In contrast, for this study the National Institute of Justice (NIJ) of the U.S. Department of Justice asked the National Research Council to focus on "desistance," which broadly covers continued absence of criminal activity and requires reintegration into society. Specifically, the committee was asked (1) to consider the current state of parole practices, new and emerging models of community supervision, and what is necessary for successful reentry and (2) to provide a research agenda on the effects of community supervision on desistance from criminal activity, adherence to conditions of parole, and successful reentry into the community. To carry out its charge, the committee organized and held a workshop focused on traditional and new models of community supervision, the empirical underpinnings of such models, and the infrastructure necessary to support successful reentry. Parole, Desistance from Crime, and Community Integration also reviews the literature on desistance from crime, community supervision, and the evaluation research on selected types of intervention.

In this book, motherhood and reproduction are identified as sites of legal, political, and ideological surveillance, regulation, and criminalization. Collectively, this rich and diverse edited volume builds on cross-disciplinary frameworks and an attention to differences among mothers to analyze multiple ways that mothers and pregnant women face culture, policy, or practices that may criminalize their identities or their actions. Several themes cross the volumes’ six chapters, from the importance of and problems related to socialized expectations of what “good mothers” should do – for incarcerated, formerly incarcerated, and never incarcerated mothers alike – to the role of state actors and everyday informal interactions in enforcing these expectations, particularly against marginalized, Black, Brown and young mothers in open-air prisons. Conflicts between motherhood ideologies and state control dominate many women under carceral motherhood. Nation-states are also implicated in these analyses, particularly in the European Union, where nation-states outsource abortion across and within geopolitical borders, making migration a contested strategy for pregnant women. Yet despite the criminalizing of motherhood and reproduction described in the text, women and mothers are also found to be resilient, choosing their identities and their actions. Criminalizing Motherhood and Reproduction will be a key resource for researchers, scholars and practitioners in the fields of feminist criminology and motherhood studies, criminology and criminal justice, women’s studies, gender studies, child and youth studies and sociology.
