This paper explores the legal and economic aspects of the management of each of the several different categories of shared stocks, namely transboundary, highly migratory, straddling and discrete high seas stocks. The economics of the issue point to the conclusion that, with few exceptions, effective cooperation between and among states is a fundamental prerequisite for sustainable resource management.

This book evaluates the major models used for estimating the size and structure of marine fish populations (stock assessments) and changes in populations over time. It demonstrates how problems that may occur in fisheries data--for example underreporting or changes in the likelihood that fish can be caught with a given type of gear--can seriously degrade the quality of stock assessments. Although the ocean-and the resources within-seem limitless, there is clear evidence that human impacts such as overfishing, habitat destruction, and pollution disrupt marine ecosystems and threaten the long-term productivity of the seas. Declining yields in many fisheries and decay of treasured marine habitats, such as coral reefs, has heightened interest in establishing a comprehensive system of marine protected areas (MPAs)-areas designated for special protection to enhance the management of marine resources. The paper discusses the problems facing countries when managing stocks of fish that move between their EEZs and the EEZs of adjacent countries, or onto the high seas. The action needed depends on the pattern of movement of the stocks. The different patterns of movement are discussed; they vary from small local dispersions in which only a small proportion of the stock cross boundaries between national EEZs to long migrations in which virtually all the stock may move from one EEZ to another. Collaboration between countries in research on shared stocks is always beneficial, and should not raise any serious problem. Collaboration in choosing and implementing management measures can be more difficult. The problems raised, and the nature of collaboration required to achieve effective management are discussed in relation to the different patterns of movement.
