This book opens up a substantive new area of legal research--knowledge production--and presents a series of case studies showing that the hybridity and eclecticism of legal knowledge processes make it unfruitful to ask questions such as, "Is law becoming more dominated by science?" Mariana Valverde argues that legal decision making cannot be understood if one counterposes science and technology, on the one hand, to common knowledge and common sense on the other. The case studies of law's flexible collage of knowledges range from determinations of drunkenness made by liquor licensing inspectors and by police, through police testimony in "indecency" cases, to how judges define the "truth" of sexuality and the harm that obscenity poses to communities. Valverde emphasizes that the types of knowledge that circulate in such legal arenas consist of "facts," values, and codes from numerous incompatible sources that combine to produce interesting hybrids with wide-ranging legal and social effects. Drawing on Foucaultian and other analytical tools, she cogently demonstrates that different modes of knowledge, and hence various forms of power, coexist happily. Law's Dream of a Common Knowledge underlines the importance of analyzing dynamically how knowledge formation works. And it helps us to better understand the workings of power and resistance in a variety of contemporary contexts. Focusing on the South African city of Durban, Security in the Bubble looks at spatialized security practices, engaging with strategies and dilemmas of urban security governance in cities around the world. While apartheid was spatial governance at its most brutal, postapartheid South African cities have tried to reinvent space, using it as a “positive” technique of governance. Christine Hentschel traces the contours of two emerging urban regimes of governing security in contemporary Durban: handsome space and instant space. Handsome space is about aesthetic and affective communication as means to making places safe. Instant space, on the other hand, addresses the crime-related personal “navigation” systems employed by urban residents whenever they circulate through the city. While handsome space embraces the powers of attraction, instant space operates through the powers of fleeing. In both regimes, security is conceived not as a public good but as a situational experience that can. No longer reducible to the after-pains of racial apartheid, this city’s fragmentation is now better conceptualized, according to Hentschel, as a heterogeneous ensemble of bubbles of imagined safety.

This book examines the paved road as a liminal space and legal frontier for enlivened, everyday struggles over property, power, and place/definition. Through pavement itself and the pavement-based practices of pavementalities and pavementeering, the road is legally framed as a place for movement. Paved terrain is a site of dynamism between law and place that engenders the road as legal metaphor by calling forth the kinetic notion of jurisprudence in which law can be understood through the fluidity of everyday life. In Western (and particularly American) society, roads are a material locus of governance, in which rights of way are determined, communicated, and enforced. However, roads also constitute a site of resistance or disruption, beyond regulation. Addressing phenomena such as travel, political protest, public memory, and community governance, this book explores the paved medium of asphalt as a complex surface for legality that constitutively frames order against disorder involving jurisdiction tensions, property ownership, and cultural identities in vehicular environments. The target audience of this book are those students and scholars who consider how law works in society, whether through frameworks of (auto) mobility and legal geography or through the interdisciplinary approaches of legal semiotics, legal culture, and/or new materialism.
