By excluding complex details, it accentuates and brings into greater relief those principal features Of the landscape upon which its character depends. Excerpt from Elements of the Law of Partnership Several years ago the writer printed for the use of his class a brief course of lectures on Partnership. A wider demand for them having sprung up, they have been revised and reprinted in the hope that they may be useful to students elsewhere. They pretend to be nothing more than the mere elements of the subject, and the endeavor has been to keep them in small compass. The citation of authorities has been purposely limited to the leading and most readily accessible cases, and those cited have been selected rather as illustrations of the text than as authorities for it. Much statement of cases in the text has been avoided, because the lectures were designed to be used and were in fact used in connection with a volume of selected cases upon the subject. It is assumed that the study of Agency will precede that of Partnership, and some knowledge of the former subject has been constantly taken for granted. If the style at times seems to be didactic, the circumstances of the original composition will serve as an explanation. These changes have been traced and explained in the text, while. In the notes, the reader has been referred to the leading cases and the best text writers, so that he may, by following the changing methods of interpretation as they appear in the authorities, learn not only what the law of partnership now is, but how it came to have its present status. There has been no attempt to make the citation of cases exhaustive upon well-estab lished propositions. But it is by no means meager. Nearly five thou sand cases being referred to in different parts of the work. Great pains has been taken in the citation of these cases to have them each exactly support the proposition to which it is cited. Excerpt from Handbook on the Law of Partnership, Including Limited Partnerships The original arrangement with the publishers contem plated, not an entirely new treatise on the law of Partner ship, but merely a new edition of Mr. William George's' text on this subject. After the work was begun, however, it seemed advisable to abandon Mr. George's text for the most part, and to prepare a substantially new treatise, us ing such portions of his work as should be found suitable. With the exception, therefore, of Chapters VIII and IX, the present book, both in arrangement and text, is new. A few passages and a number of citations and notes have been taken from Mr. George. Chapters VIII and IX are repro duced substantially as found in Mr. George's book, with the addition of later cases. The law on the subject being rea sonably well worked out in the authorities, the aim of the present author has been to make a clear and definite state ment of the leading principles, in a form serviceable alike to students and practitioners. Whatever merit the book has lies in this direction, rather than in the discussion of controverted points, or the advancement of new theories. The citations, while including all the leading cases, are not exhaustive, but are sufficiently full for practical purposes. This being said, it is almost superfluous to say that I agree with him in thinking the Indian Codes a desirable model for the exposition of English law, by authority if possible, but if and so far as that is too much to hope for, then by private endeavor; and that I likewise agree with the reasons which he has given for that opinion, both in the intro duction to his Digest of the Law of Evidence and on various other occasions.
