Book Description
Excerpt from Principles of the Law of Partnership This Treatise makes no pretence to the position of a text book. It is merely a broad sketch giving the salient features Of the subject. For the finished picture, with its wealth of detail, the reader must turn to the elaborate work of Lord lindley. But although a sketch is necessarily a humble work, like other humble things it has its uses. By excluding complex details, it accentuates and brings into greater relief those principal features Of the landscape upon which its character depends. So in students' law books, if one can generalise the wilderness of single instances embalmed in the reports, and extract therefrom some broad principles - ii one can, as bacon puts it, rather excite the judgment brie y than inform it tediously - the work will not be altogether useless. For these reasons it is hoped that law students and commercial men may find in this little book a readable and concise, and it is believed an accurate View of the main principles of the law of partnerships. For the convenience of practitioners an Appendix has been added to this Edition, containing a print of the Partnerships Act, 1890. Need I make acknowledgment of my indebtedness to Lord lindley? It goes without saying. NO one whovi preface. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Description
Excerpt from Elements of the Law of Partnership Several years ago the writer printed for the use of his class a brief course of lectures on Partnership. A wider demand for them having sprung up, they have been revised and reprinted in the hope that they may be useful to students elsewhere. They pretend to be nothing more than the mere elements of the subject, and the endeavor has been to keep them in small compass. The citation of authorities has been purposely limited to the leading and most readily accessible cases, and those cited have been selected rather as illustrations of the text than as authorities for it. Much statement of cases in the text has been avoided, because the lectures were designed to be used and were in fact used in connection with a volume of selected cases upon the subject. It is assumed that the study of Agency will precede that of Partnership, and some knowledge of the former subject has been constantly taken for granted. If the style at times seems to be didactic, the circumstances of the original composition will serve as an explanation. Book Description
Excerpt from Handbook of the Law of Partnership The aspect of the partnership relation nas undergone many chang es during the century now closing. These changes have been traced and explained in the text, while. In the notes, the reader has been referred to the leading cases and the best text writers, so that he may, by following the changing methods of interpretation as they appear in the authorities, learn not only what the law of partnership now is, but how it came to have its present status. There has been no attempt to make the citation of cases exhaustive upon well-estab lished propositions. But it is by no means meager. Nearly five thou sand cases being referred to in different parts of the work. Great pains has been taken in the citation of these cases to have them each exactly support the proposition to which it is cited. Long lists of cases have been avoided, and, as far as possible in a one-volume work on so extensive a subject, the cases have been classified in the notes and the specific points decided have been stated. It is believed that all the leading American and English cases are included. In citing statutes throughout the book, the last general revision in the several states has in each case been consulted. Excerpt from Contracts and Partnership, Vol. 4: Containing All the Essential Elements Necessary to Make a Complete and Binding Contract, Together With a Full Explanation of the Law of Partnership, With Many Forms of Both Contracts and Partnerships Previous numbers of the Cyclopedia of Law having met with nothing but success and approval, the author feels disinclined to apologize for attempting to give within the limit of 200 pages the principles of the two important branches of Contract and Partnership. He does not expect that the reader or student will find in the present book all that is contained in the well known text-books upon these subjects. Nor is he ready to admit that a larger or more comprehensive book is desirable to answer the purpose intended by the volumes of the Cyclopedia of Law. It is only the aim and purpose of the Series to furnish in convenient and inviting form the principles and ele ments of the American law. Book Description
Excerpt from Handbook on the Law of Partnership, Including Limited Partnerships The original arrangement with the publishers contem plated, not an entirely new treatise on the law of Partner ship, but merely a new edition of Mr. William George's' text on this subject. After the work was begun, however, it seemed advisable to abandon Mr. George's text for the most part, and to prepare a substantially new treatise, us ing such portions of his work as should be found suitable. With the exception, therefore, of Chapters VIII and IX, the present book, both in arrangement and text, is new. A few passages and a number of citations and notes have been taken from Mr. George. Chapters VIII and IX are repro duced substantially as found in Mr. George's book, with the addition of later cases. The law on the subject being rea sonably well worked out in the authorities, the aim of the present author has been to make a clear and definite state ment of the leading principles, in a form serviceable alike to students and practitioners. Whatever merit the book has lies in this direction, rather than in the discussion of controverted points, or the advancement of new theories. The citations, while including all the leading cases, are not exhaustive, but are sufficiently full for practical purposes. The author acknowledges his great indebtedness for valua ble assistance in the task to Mr. Henry A. Hirshberg and to Mr. Oliver S. Rundell; also to Mr. Olcott O. Partridge for his preparation of the chapter on Limited Partnerships. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Description
Excerpt from A Digest of the Law of Partnership Digest of the Criminal Law. This being said, it is almost superfluous to say that I agree with him in thinking the Indian Codes a desirable model for the exposition of English law, by authority if possible, but if and so far as that is too much to hope for, then by private endeavor; and that I likewise agree with the reasons which he has given for that opinion, both in the intro duction to his Digest of the Law of Evidence and on various other occasions. Some of those reasons, however, I may, without presumption, try to restate in my own way, this being a topic on which repetition is certainly not vain in the sense of being needless; and it seems also proper, in addition to this general statement, to explain why the subject of Partnership appears to me a specially fit one for an experiment of this kind.
