While there is a large, though inconclusive, literature on the impact of land titles in Africa, little attention has been devoted to the study of land conflict, despite evidence on increasing incidence of such conflicts. Deininger and Castagnini use data from Uganda to explore who is affected by land conflicts, whether recent legal changes have helped to reduce their incidence, and to assess their impact on productivity. Results indicate that female-headed households and widows are particularly affected and that the passage of the 1998 Land Act has failed to reduce the number of pending land conflicts. The authors also find evidence of a significant and quantitatively large productivity-reducing impact of land conflicts. This suggests that, especially in Africa, attention to land-related conflicts and exploration of ways to prevent and speedily resolve them would be an important area for policy as well as research. This paper--a product of Rural Development, Development Research Group--is part of a larger effort in the group to explore the impact of land policies.

"The theorized impact of land tenure and titling on access to credit has produced mixed results in the empirical literature. Land tenure and titling is hypothesized to increase access to credit because of the enhanced land security provided and the newfound ability to use land as collateral. Using land as collateral and obtaining access to credit are paramount concerns in Uganda and in all of Africa, as greater emphasis is placed on the need to modernize the agricultural system. This paper uses a new approach in evaluating whether land tenure and titling have an impact on access to credit for rural households in Uganda. The new approach includes comparisons across four categories: (1) households who have customary land with versus without a customary certificate, (2) households who have freehold land with versus without a title, (3) households with a title or certificate having freehold versus customary tenure, and (4) households without a title or certificate having freehold versus customary tenure. Each comparison is then evaluated for the impact on access to any form of credit, formal credit, and informal credit. This analysis allows for an in-depth look into which element, tenure or title, is impacting access to credit and to which type of credit, formal or informal. To conduct this analysis, matching techniques are used, including propensity score matching and the Abadie and Imbens matching method. These two methods contain both strengths and weaknesses that allow the results to support to one another. The only significant finding of the matching was a positive impact on access to credit of freehold without title over customary without certificate. Results imply that tenure, not title, impacts credit access for rural households in Uganda."--Authors' abstract.

This book is the first systematic attempt to address emerging land markets and their implications for poverty, equity, and efficiency across a number of African countries. The high incidence of poverty and the need for increased agricultural productivity remain acute in rural areas of sub-Saharan Africa, where a lack of secure land rights and a growing scarcity of land relative to the size of the population are becoming increasingly critical issues. Indeed, land issues in the region are high on the international policy agenda. Yet our knowledge about land tenure security and other rural factor markets (such as labor, oxen, manure, purchased inputs, and credit) is far from adequate to formulate sensible policies. The case studies in the book show that, while land markets and especially informal markets have been rapidly emerging in densely populated parts of Africa - and have generally been to the benefit of the poor--their functions remain imperfect. This is due to policy-induced tenure insecurity and the fragmentation of agricultural land. Applying rigorous quantitative analyses, the book provides a basis for taking into account the role of land markets in national land policies. All too often, the authors argue, land policies have been extreme, either prohibiting all land transactions or giving unrestricted freehold rights to a small elite at the expense of the poor. From the long experience in Asia, it is known that such policies are detrimental to both production efficiency and equity of land use. The authors argue that future policies in Africa should work with the markets. Regulations should be imposed only with careful testing that they are having the intended effects. The Emergence of Land Markets in Africa is a resource for teaching in developed and developing countries, as it provides both comprehensive reviews of the literature and detailed case studies. It is intended to facilitate the dialogue between researchers and policymakers, as well as inspire researchers to go further in their investigations and build an even stronger basis for good policies. The authors use data from Uganda to assess the impact of a disaggregated set of rights on investment, productivity, and land values, and to test the hypothesis that individuals' lack of knowledge of the new law reduces their tenure security. Results point toward strong and positive effects of greater tenure security and transferability.
